1. Acceptance of Terms

By accessing and using the services of David M. Tidwell & Associates, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

We provide professional real estate appraisal services including:

  • Residential property appraisals
  • Commercial property appraisals
  • Land and agricultural property appraisals
  • USPAP-compliant valuation reports
  • Expert testimony and consultation services

3. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information about the property
  • Grant necessary access to the property for inspection
  • Pay agreed-upon fees in a timely manner
  • Provide required documentation and records
  • Cooperate with the appraisal process

4. Appraisal Process

Our appraisal process includes:

  • Property inspection and documentation
  • Market research and analysis
  • Comparable property analysis
  • Value determination using appropriate approaches
  • Comprehensive written report preparation

5. Fees and Payment

Appraisal fees are determined based on:

  • Property type and complexity
  • Scope of work required
  • Urgency of the assignment
  • Travel requirements

Payment is due upon completion of the appraisal report unless other arrangements have been made in writing.

6. Report Delivery

Reports are delivered per engagement and are based on current workload and complexity. Many factors may impact delivery times, not all of which are in the appraiser's control. Delivery timelines are discussed at engagement and may vary based on property type, data availability, and scope of work.

7. Limitation of Liability

Our liability is limited to the amount paid for the appraisal service. We are not liable for any indirect, incidental, or consequential damages arising from the use of our appraisal reports.

8. Confidentiality

We maintain strict confidentiality of all client information and property details. Information is shared only as required by law or with your explicit written consent.

9. Professional Standards

All appraisals are conducted in accordance with the Uniform Standards of Professional Appraisal Practice (USPAP) and applicable state and federal regulations. We maintain professional liability insurance as required by law.

10. Dispute Resolution

Any disputes arising from our services will be resolved through good faith negotiation. If resolution cannot be reached, disputes will be settled through mediation or arbitration as appropriate.

11. Cancellation Policy

Cancellations must be made in writing at least 24 hours before the scheduled property inspection. Late cancellations may result in a cancellation fee of up to 50% of the agreed-upon fee.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified terms.

13. Governing Law

These terms are governed by the laws of the State of California. Any legal actions must be brought in the courts of Humboldt County, California.
